 What are the two legal sections to evict a tenant?

In England & Wales the two sections of the Housing Act 1988 that relate to eviction of tenants are known as ‘Section 8’ and ‘Section 21’.

How much notice does a Section 21 notice have to give?

A Section 21 notice must give at least 2 months’ notice. You may need longer if you have a ‘contractual’ periodic tenancy. Our solicitors can advise you on how best to proceed.

Are Section 21 evictions being banned?

The government has announced that it will legislate to end Section 21 evictions. The provisions of Section 21 that most landlords find useful will be migrated to Section 8. 

What happens if my tenant doesn’t leave following a notice?

Following the appropriate notice being issued and the tenant still refusing to leave it will be possible to take the matter before a court. We will issue proceedings, and the court will give your tenant 14 days to submit a defence. Following a court hearing that awards in your favour as a landlord the tenant must leave by the date provided by the court, and they may face eviction enforcement if they fail to do so.
